Maximizing Phase 2: Making the Most of Your Time at the Window

Course Description:
In the “three phases of DWI detection”, Phase 2 involves initial personal contact between the officer and the driver and extends through exiting the vehicle. While sobriety testing (part of Phase 3) tends to get most of the attention in any discussion of impaired driving enforcement, Phase 2 is (arguably) where the best cases are made.

While jurors hearing a DUI/DWI case may have a difficult time understanding sobriety testing from an officer’s short time on the stand, everyone in the box came to court with a clear understanding of how an intoxicated person looks, walks, talks, and acts. These “common sense” observations can carry significant weight in a case, but the art of conducting a thorough Phase 2 investigation requires skill and experience.

In this course, Don Marose shares experiences from his extensive career to help learners gain new insights to enhance their Phase 2 investigation.
